A former MP for Wheeling Hospital has filed a whistleblower lawsuit claiming his employer routinely paid bribes to doctors in exchange for patient referrals. Detroit's William Beaumont Hospital paid $85 million last August to settle allegations that it provided free or discounted practices to doctors, subsidized assistant costs, and subsidized the cost - of assistants - in exchange for referrals, court documents show. A month later, the Kalispell Regional Healthcare System in Montana paid $24 million to settle a lawsuit in which 63 specialists were overcompensated and paid more than $1 million a year in compensation if they worked for much less. The lawsuit says the hospital paid a heart surgeon $770,000 and gave him 12 weeks off, even though his heart team regularly went into the red.
In addition, Wheeling paid $1.5 million to obstetricians and gynecologists for their departments to "bleed money," according to the lawsuit. The lawsuit relates to a whistleblower, Dr. John W. Smith Jr., and two other doctors.
He attended and graduated from Marshall University School of Medicine and earned a PhD in Obstetrics and Gynecology and a Master's degree in Pediatrics from West Virginia University. Among the referrals from doctors were those from obstetricians and gynecologists, who the hospital hired in 2009. The hospital's management, according to the lawsuit, closely monitored how much doctors earned for the hospitals and looked after the most lucrative referrals. The managers allegedly tracked "how much turnover each doctor generates" to pay them accordingly.
He has been affiliated with many hospitals, including West Virginia University Medical Center, University of Virginia Health System and Virginia Medical College of Medicine.

Together, these rules are intended to eliminate financial incentives that can lead doctors to order out-of-home tests and treatments that make Medicare and other insurers more expensive and expose patients to unnecessary risks. One problem is that hospitals are buying more and more doctors "offices and putting doctors on their payroll. The number of hires and acquisitions has increased as hospitals clash with federal law that requires them to pay doctors a fair market value for their services, regardless of how much extra business they earn from referrals. Doctors, hospitals, insurance companies and lobbies make it expensive and difficult for patients to bring a lawsuit.
